Patient Bill of Rights

At Brooks, the process of rebuilding lives is our specialty. We are here to work with you, your family and your physician. We want your stay with us to be as pleasant as possible. As a patient at Brooks you have legal rights and responsibilities. They are detailed below.

One of your most important rights is your right to privacy. Our policies are very clear, and you can find them outlined in our Notice of Privacy Practices.

Your other rights and responsibilities are as follows. If you have any questions at any time, please ask a member of your treatment team, or you can contact Patient Advocate, Gloria Booth at (904) 858-7745.

Rights And Responsibilities

The Patient Bill of Rights Section 381.026(6) Florida Statutes:
The patient has the right, under all circumstances, to considerate, respectful and individualized care including, but not limited to:

  1. The right to an appreciation of his/her dignity, and with protection of a need for privacy.
  2. The right to know that rules and regulations apply to his/her conduct.
  3. The right to impartial access to available, indicated medical treatment or accommodations regardless of race, national origin, religion, physical disability, gender, age, marital status, or sources of payment.
  4. The right to transfer to another facility in response to patient request or medical need should the care needed be beyond the capacity, mission, legal and regulatory scope of the hospital. Transfer may occur only when medically permissible, after having completely informed the patient, explaining the need for such a transfer to the patient and obtaining acceptance from the receiving institution.
  5. The right to considerate, respectful and responsive care based on an appreciation of the patient’s individuality.
  6. The right to recognition of existing advance directives from the patient, within the limits of the organization’s mission and philosophy.
  7. The right to recognition of and support for the needs of the dying patient based upon any knowledge of the patient’s desires.
  8. The right to prompt and reasonable responses to questions and requests.
  9. The right to be given complete and current information concerning known diagnosis, planned course of treatment, alternatives, risk and prognosis. Such information should be obtained from the attending physician in terms understandable by the patient. Should the attending physician consider giving such information to the patient inadvisable, it should be made available to a legally authorized individual.
  10. The right to know who is providing medical services and who is responsible for his/her care.
  11. The right to know what patient support services are available, including presence of an interpreter if necessary.
  12. The right to expect that he/she is a partner in planning his/her care and treatment as an informed participant.
  13. The right to expect that his/her care will be delivered within an ethical framework established by the profession, organization and the law.
  14. The right to receive care in surroundings assuring reasonable auditory and visual privacy.
  15. The right to have access to his/her medical record within the limits and specific provision of applicable law, and to have the record read only by individuals involved in his/her care.
  16. The right to request a transfer to another room if a suitable room is available.
  17. The right to know that in the event the patient is adjudicated incompetent in accordance with the law, found to be medically incapable of understanding proposed treatment/procedure, unable to communicate wishes regarding treatment or is an unemancipated minor, the guardian, next of kin or legally authorized responsible person will be asked to exercise, to the extent permitted by law, the rights delineated for the patient.
  18. The right to refuse treatment to the extent permitted by law. When refusal of treatment by the patient or legally authorized representative prevents appropriate medical care in accordance with professional standards or needs, the patient will be informed of the medical or financial consequences. The relationship with the patient may be terminated upon reasonable notice.
  19. The right to treatment for any emergency medical condition that will deteriorate from failure to provide treatment.
  20. The right to be given, upon request, full information and necessary counseling on the availability of known financial resources for his/her care.
  21. The right to receive, upon request prior to treatment, a reasonable estimate of charges for medical care.
  22. The right to know if medical treatment is for purposes of experimental research and to give his/her consent or refusal to participate in such research.
  23. The right, if eligible for Medicare, to know, upon request, and in advance of treatment, whether the health care provider or health care facility accepts the Medicare assignment rate.
  24. The right to receive a copy of a reasonable and understandable itemized bill and, upon request, to have the charges explained.
  25. The right to express grievances regarding any violation of his/her rights, as stated in Florida Law, through the grievance procedure of the health care provider or health care facility which served him/her and to the appropriate state licensing agency.

The Patient’s Responsibilities

The patient needs to participate in his/her health care. The patient, parent or legal guardian is responsible for:

  1. Providing accurate and complete information about present complaints, past illnesses, hospitalization, medications and other matters relating to his/her health.
  2. Reporting to the responsible physician, nurse or therapist any perceived risks in his/her care and unexpected changes in his/her condition.
  3. Asking questions when he/she does not understand any issue related to patient care or expectations.
  4. Reporting that he/she clearly understands the plan of action for his/her needs.
  5. Following treatment plan recommended.
  6. Keeping appointments and notifying the provider when he/she is not able to do so for any reason.
  7. His/her actions and consequences in the event recommended treatment is refused.
  8. Ensuring financial obligations are fulfilled.
  9. Following rules and regulations regarding patient care and conduct.
  10. Being considerate of the rights of other patients and assisting in the control of noise, number of visitors, and observance of smoking policies. Smoking is prohibited at the facilities except in designated areas.
  11. Plan to actively participate in three hours of therapy at least five days a week.

All persons, patients, visitors, and our staff and physicians shall be treated with respect and dignity. This is a right due all persons regardless of race, national origin, religion, physical disability, gender, age, marital status, or sources payment.

Patient’s Rights and Responsibilities for Pain Management

Patients are involved in all aspects of their care, including managing pain effectively. Patients have the right to the appropriate assessment and management of pain including, but not limited to:

  1. Information about pain and pain relief measures.
  2. Treatment by concerned staff who are committed to pain prevention and management.
  3. Health Professionals who respond to reports of pain.
  4. Staff who demonstrate belief and acknowledgment of reports of pain.
  5. Staff trained in pain management.

The Patient’s Responsibilities:

  1. Asking what to expect regarding pain and pain management.
  2. Discussing pain relief options with the health care team.
  3. Working with the health care team to develop a pain management program.
  4. Asking for pain relief or management when pain first begins.
  5. Helping the health care team assess the pain.
  6. Telling the health care team when the pain is not relieved or managed.

In accordance with Joint Commission on Accreditation of Healthcare Organizations, Standard for Pain Management, RI1.2, “Patients are involved in all aspects of their care,” effective January 1, 2001.
